Privacy Policy

BizAdvisor Digital Sdn Bhd and its affiliates, related and associated companies (collectively referred to as “we, us, our or BizAdvisor Digital”) comply with the Personal Data Protection Act 2010 (the “Act) and other applicable privacy legislation when dealing with personal data

This policy sets out how we will collect, use, disclose and protect your personal data in connection with our services. This policy does not limit or exclude any of your rights under applicable legislation, except to the extent permitted by law.

1. INFORMATION WE COLLECT 

We collect and maintain your personal data during your visit to our website or given to us in any other way. By browsing our website and submitting any information to us, you explicitly agree to BizAdvisor Digital using your personal data for the purposes and in the manner described in this Privacy Policy. Please do not send us any information you do not wish BizAdvisor Digital to use. 

You can choose not to provide certain information, but you may not be able to enjoy all the features of our website and services provided by us. Personal data we learn from you helps us to personalise and continually improve your online experience. Personal data collected varies and may include the following information: 

  • Personally identifiable information e.g. name, photo, gender, date of birth, nationality, passport/identification card number and country of residence;  
  • Contact information e.g. address, email address and phone numbers; 
  • Payment information e.g. credit or debit card information, including the name of cardholder, card number, card issuing bank, card issuing country, card expiry date and banking account details; 
  • Business and financial information e.g. registration of company certificate, registration forms, company profile, shareholders’ information, professional accreditation, full audited financial reports, audited accounts, income tax returns, bank statement, letter of credit, term loans, bank guarantee, overdraft, agreements (e.g. tenancy, supplier, etc.), past purchase orders, invoices, payment vouchers, other debtor and creditor-related documents, access information to social media (e.g. Facebook, YouTube, Instagram, LinkedIn etc.) and marketing (e.g. Google Ad Manager, Facebook Ads Manager, Google Analytics, Google Tag Manager, Customer Management System etc.) accounts; and 
  • Technical information e.g. IP address, device identifier, web browser, and browsing information collected through cookies, device information, cookies preferences. 

 

2. HOW WE COLLECT YOUR PERSONAL DATA FROM

Your personal data has and/or will be collected from the following sources: 

  • you, when you provide that personal data to us, including via the website and any related service, through any registration process, through any contact with us (e.g. via telephone call, email, message such as SMS, or any other instant messaging applications such as WhatsApp or Telegram etc.), or when you use our services. 
  • third parties, in the course of their business activities including in connection with our services, where you have authorised this, or the information is publicly available. This includes demographic, professional and other information that is publicly available online, including information you choose to make public through social media platforms and other public online forums. 

If possible, we will collect personal data from you directly. Where we need to verify your identity (for example, if there are concerns around identity theft, or if you call us), we may request that you provide us with government-issued identification information. 

 

3WHY WE COLLECT YOUR PERSONAL DATA

4. DISCLOSURE OF YOUR PERSONAL DATA 

We will not sell, rent, transfer or disclose any of your personal data to any third party without your consent. We may disclose your personal data to:

  • our advisors and any business that supports our services 
  • any other professional service providers appointed in connection with our business on a strictly confidential basis, appointed by us to provide services to us 
  • any party nominated or appointed by us either solely or jointly with other service providers, who provide services or conduct data processing on our behalf, or for data centralization and/or logistics purposes 
  • a credit reference agency for the purpose of credit checking you, where necessary 
  • a person who can require us to supply your personal data or authorised by applicable law (e.g. a regulatory authority, law enforcement agency) 
  • data centres and/or servers located within or outside your country for data storage purposes 
  • storage facility and records management service providers 
  • any other person authorised by you. 

Any third parties with whom we share your personal data are limited in their ability to use your personal data for any purpose other than to provide service to us. We will always ensure that any third parties with whom we share your personal data are subject to the data protection principles under Malaysian law.  

All personal data you provide to us is stored on our secure servers in Malaysia. Additionally, a business that supports our service may be located outside Malaysia. This may mean your personal data is held and processed outside Malaysia. 

 

5. HOW LONG DO WE RETAIN YOUR PERSONAL DATA 

  • We retain your personal data, as necessary, for the duration of the relevant business relationship and for as long as the purposes for which the personal data was collected continues. This means your personal data will be destroyed or anonymised from our records and back-up systems in the event your personal data is no longer required for the said purposes. 
  • We may also retain personal data for longer than the duration of the business relationship should we need to retain it to protect ourselves against legal claims, use it for analysis or historical record-keeping, or for audit purposes and to comply with the law, except when we receive a valid erasure request, your personal data is purged pursuant to our standard purge process. 

 

6. ACCESSING AND CORRECTING YOUR PERSONAL DATA 

In accordance with applicable data protection laws, you may have the right to access your readily retrievable personal data that we hold and to request reasonable corrections to your personal data to ensure that the personal data you provide to us is correct, complete and accurate. You may also use these contact details to notify us of any privacy complaint you have against us, including if you think that we have failed to comply with the Act. To help protect your privacy and security, we will take reasonable steps to verify your identity, before granting access to your personal data. 

We reserve the right to charge an appropriate fee for complying with your request where allowed by applicable law, and/or deny your requests where they may be manifestly unfounded, and/or excessive, or otherwise objectionable or unwarranted under applicable law.

7. UPDATES TO OUR PRIVACY POLICY 

In order to stay compliant with the applicable privacy legislation, we reserve the right to change, amend and/or vary this policy by uploading a revised policy onto website. The change will apply from the date that we upload the revised policy. 

In the event of any conflict between this English language Privacy Policy and its corresponding Bahasa Malaysia Privacy Policy, the terms in this English language Privacy Policy shall prevail. 

 

8. INTERNET USE & HOW WE USE COOKIES 

While we take reasonable steps to maintain secure internet connections, if you provide us with personal data over the internet, the provision of that information is at your own risk. 

If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal data. We suggest you review that site’s privacy policy before you provide your personal data. For the avoidance of doubt, we shall not be responsible for the contents, accuracy and/or opinions expressed in other sites. 

We may use cookies to keep track of your visit to our website and our communications with you. A cookie does not give us access to your computer or any information about you, other than the data you choose to share with us. You may disable cookies by changing the settings on your browser, although this may mean that you cannot use all of the features of the website. 

 

9. SECURITY 

We take appropriate technical and organisational measures to protect your personal data from loss, unauthorised activity, or other misuse. Only authorized personnel and third party service providers are provided access to personal data, and these employees and service providers are required to treat this information as confidential. Despite these precautions however, we cannot guarantee that unauthorized persons will not obtain access to your personal data.  

 

10. CONSENT 

We or any third party engaged by us will obtain your consent and use your personal data at the time of collection, subject to certain legally prescribed circumstances where your consent is not required. Where required by law, we will obtain your express written consent when collecting your personal data, and we will obtain your explicit consent if we process your sensitive personal data. You may be asked to sign a form or tick a box.
